The seminar will be delivered by  Nicholas Le Poidevin, Q.C. and Aidan Briggs.

Rectification and Mistake 
Following three recent decisions of the Jersey Courts and the Privy Council, this talk considers the correct legal approach to mistakes by trustees, drafting errors and the effect of undue influence, with a particular view to how this affects decisions by trust-owned companies. It will also consider the analysis of the new arts.47G and 47H Trusts (Jersey) Law and give some practical advice on approaching such problems.
  • In what circumstances will trustee-directors be able to set aside decisions made in relation to trust-owned companies?
  • When is rectification of a trust instrument available and how should such applications be approached?
  • How have the new arts.47G and 47H been interpreted by the Courts?
  • When may an exercise of a power be set aside for undue influence?
