Kenneth Munro’s practice consists almost entirely of real property related work and associated professional negligence. It is largely contentious but has a substantial non-contentious element.

His notable cases include the ground breaking decision of the House of Lords in Mannai Investment Co. Ltd. v Eagle Star Life Assurance Co. Ltd. He was counsel for the Respondents in the House of Lords in the leasehold enfranchisement case of Shalson v Keepers and Governors of the Free Grammar School of John Lyon. He was instructed by the Inland Revenue to argue the real property aspects of the appeal in the House of Lords in Jerome v Kelly.

Recent successes have been a successful series of enfranchisement appeals in the Lands Tribunal culminating in Arbib v Cadogan which overturned the accepted valuation practice in enfranchisement cases on the major London Estates, adding considerably to the value of those Estates.  His latest success was Cadogan v Sportelli, five appeals heard together, in which he succeeded in persuading the House of Lords that “hope value” is recoverable as part of the value of the landlord’s interest in collective enfranchisement cases. The decision and that of the Court of Appeal in the same appeal have application throughout England and Wales.

He appeared recently in the Court of Appeal for the successful tenant in Princes House Ltd v Distinctive Clubs Ltd, an important commercial dilapidations case, and one of the most important cases in recent times, acting for the landlord in Cadogan v Sportelli, a case of major and countrywide importance concerning statutory valuations in enfranchisement cases and the role of the Lands Tribunal in giving guidance to Leasehold Valuation Tribunals.

He is instructed regularly in the Chancery Division, the TCC, the Lands Tribunal and the LVT. His practice covers commercial and residential property. He concentrates on landlord and tenant and conveyancing but covers most aspects of real property law including easements, restrictive covenants and torts affecting land. He is instructed by most of the large London estates, by property investors, developers and commercial and residential property owners. He acts for both landlords and tenants.
