Mark Hubbard specialises in commercial and chancery litigation, with an emphasis on offshore trust and company cases, company and insolvency, trusts and administration of estates, civil fraud, negligence of legal professionals and conflicts of laws. He is listed as a leading junior in the current editions of Legal 500 (private client: personal tax, trusts & probate; insolvency) and Chambers & Partners (civil fraud; chancery: traditional).

His recent cases include two notable trusts law decisions: Re Nordea Trust Company (IoM) Ltd (2009, IoM, Chancery Division) and Howell v Lees-Millais [2009] EWHC 1754, [2009] 2 P & CR D60; Weissfisch v Davis (2009, Bahamas, Court of Appeal), a recusal application; R v Baines (2009, IoM, Court of General Gaol Delivery), where Mark acted as a civil junior defending Manx former trustee on a money laundering charge involving the transfer of $175m; also in 2009 Mark acted for the new trustee in the well known high-value Jersey trust case Alhamrani v Alhamrani; Soutzas v Asombang [2008] All ER (D) 16 (May), where Mark obtained an interim proprietary freezing injunction in the context of civil fraud and the A v B litigation, an ongoing large multi-jurisdictional case involving, amongst other things, trusts and international commercial arbitration, see A v B [2007] 1 Lloyd’s Law Rep 237, [2007] 1 All ER 591 (Comm).

Mark also appeared in X v A [2006] 1 WLR 741, a widely reported decision on the limits of the discretionary powers of trustees; Grace v Biagioli [2006] BCC 82 CA a successful appeal against the refusal to grant a minority shareholder a buy-out order, Malcolm v Benedict Mackenzie [2005] 1 WLR 1238 CA, which focused on the interaction between insolvency, human rights and pension trust law, the Poyiadjis litigation [2001-03] MLR 478, [2003-05] MLR 198, where Mark represented the trustees in a large and complex case involving several jurisdictions, hundreds of millions of dollars and which raised many issues relevant to offshore trusts, conflicts of laws and proceeds of crime, Union Discount v Zoller [2002] 1 WLR 1517 CA the leading case on the awarding of costs as damages for breach of exclusive jurisdiction clauses, Carr-Glynn v Frearsons [1997] 2 All ER 614 CA, an important decision on the scope of a solicitor’s professional duties in a private client context. Mark is regularly instructed in cases offshore or with an international element. Mark has particular experience of litigating in the Bahamas, the Isle of Man, Guernsey and Jersey.
