Comment:

Watson was junior Counsel for the the Claimants, two companies incorporated in the BVI, who claimed damages under the Georgian law of delict, on the basis that the Defendant had misappropriated their valuable real estate assets in Georgia.  The Defendant’s primary defence was that, pursuant to oral agreements formed in the mid-2000s, he was the beneficial owner of the shares in the Claimant companies, alternatively their assets. This was the Phase I trial, concerned with liability only, which took place before Peter Smith for 12 days in May 2015.  The Claimants were successful – judgment was entered in their favour in a sum to be assessed.
