The Claimant and Defendant had entered into a joint venture agreement for the development of a property in Hull whereby the Defendant would provide finance and the Claimant would carry out development work converting the property to residential premises. The dispute centred on whether an agreement had been made extending time for completion of the development.

Caley acted as sole Counsel for the successful Defendant, and the claim was dismissed in its entirety after a 3 day trial. The judgment considered a number of complex arguments raised by the Claimant including matters such as loss of a chance.
