Facts:
The underlying claim is an amalgamation of claims against a British businessman for alleged breaches of commercial agreements. A number of such claims were assigned to an LLP incorporated as an SPV for the purposes of bringing such claims. The Defendant applied to strike out the claims on the grounds that the assignments were void for Champerty.
Comment:
Caley appeared as junior Counsel for the Applicant, led by Nicholas Vineall QC. The case is among the leading authorities on the doctrine of Champerty. HHJ Barker QC gave permission to appeal, and the matter will be heard by the Court of Appeal in June 2016.
