Facts:

The Applicant sought a wasted costs order personally against a solicitor who had supervised litigation brought against the Applicant with the assistance of a non-regulated entity which provided litigation services.

Comment:

Caley acted for the Applicant and successfully argued that the solicitor should be personally liable for the sums incurred as a result of the unreasonable conduct of the litigation, in circumstances where only the solicitor was authorised to conduct litigation under the Legal Services Act.
