George Laurence QC and Simon Adamyk appear in the Supreme Court

George Laurence QC and Simon Adamyk appeared in the Supreme Court.  They represented the NHS in a dispute over the registration of land belonging to the NHS as a town or village green under section 15 of the Commons Act 2006.  R (NHS Property Services Ltd) v Surrey County Council, UKSC 2018/0109 concerned land adjacent to Leatherhead Hospital.  It addressed the question whether the doctrine of statutory incompatibility (as explained by the Supreme Court in R (Newhaven Port and Properties Ltd) v East Sussex County Council [2015] UKSC 7) applied so as to prevent land from being registered as a town or village green where it is held for NHS statutory purposes.  It also raised the question whether the use by the public of the land during the 20 year period was with the implied permission of the landowner.  The appeal was heard over two days and judgment is awaited.
