Cross-examination of a respondent to a Norwich Pharmacal/Bankers Trust v Shapira disclosure order was ordered (pursuant to s 37 of the Senior Courts Act 1981) in circumstances where there were strong grounds: (a) for believing that the respondent’s disclosure under the Norwich Pharmacal/Bankers Trust order was seriously incomplete; (b) for thinking that the respondent’s exposure to cross-examination might well be more productive of further information; and (c) for concluding that there was no other obvious person in the jurisdiction from whom to seek the information which would assist in tracing misappropriated assets.
