Malcolm acted for the Petitioner in a section 994 Petition. The litigation ended with a five day trial to value the Company, and thus the Petitioner’s 40% shareholding. Such hearing dealt with a number of valuation issues including the question as to what methodology should be adopted for the valuation. The Petitioner’s expert favoured a discounted cash flow method, as opposed to the multiples method adopted by the Respondent’s expert.
