Malcolm has acted for the Claimant in a series of cases in which competitors misrepresent to customers and potential customers that they are somehow a part of the Claimant. The causes of action are infringement of registered trade mark and passing off. These inexcusable misrepresentations to the general public cause substantial damage to the Claimant. Furthermore the activities of the Defendants can also have the effect on vulnerable consumers. Thus it is important to the Claimant to ensure that any such conduct is stamped upon as soon as it is discovered by interim injunctions if necessary.
