Facts:
The Applicant solicitor sought security for costs against the Respondent, a company based overseas, for an application by the company that the solicitor pay the wasted costs of two sets of proceedings in which the company had been Defendant and the solicitor had acted for the Claimant.
Comment:
Caley acted for the Respondent and successfully argued that the Court had no jurisdiction to make an order for security for costs against a defendant on an application for a wasted costs order and that in any event, the Applicant had failed to show that the criteria for ordering security for costs were met.
