The Claimant, the UK arm of a Danish business, has brought proceedings in London for misuse of confidential information.  The Defendants are subsidiaries of UK and US media conglomerates and a major Swedish broadcaster.  The Second Defendant challenged jurisdiction and all Defendants applied to strike out the claim for limitation and on the merits.

The case will decide whether for the purposes of the Judgments Regulation (recast), actions for breach of confidence are matters relating to contract or matters relating to tort and whether breach of confidence should be categorised as a restitutionary claim for unjust enrichment, in light of the Court of Appeal's tentative suggestions in Douglas v Hello! (No 3)
