This was an appeal to the Hong Kong Court of Appeal arising out of a contract for extraction of construction piles in locations on Hong Kong Island that were impeding the way of tunnel boring machines for an extension to the MTR railway network.  SNE, the Japanese inventor of a method for extracting the piles without damage to the surrounding land brought proceedings in Hong Kong when its contract was terminated and its method of extraction was used by the defendants' subcontractors instead.

The Court reviewed the Hong Kong short term patent in dispute and held that the trial judge’s findings in favour of the sub-contractors were unimpeachable.
