Patel v Ferdinand: winding-up most appropriate remedy on a s.994 Petition

Caley Wright acted for the successful Petitioner in Patel v Ferdinand [2016] EWHC 1524 (Ch), establishing that the Respondent’s conduct in paying herself unlawful ‘dividends’ amounted to unfair prejudice under s.994 of the Companies Act. The Court determined that winding-up was the most appropriate remedy.
