Four Members of New Square Chamber appear in The Supreme Court

The above members of New Square Chambers appeared in the Supreme Court to hear an appeal from Dorset County Council against Lord Justice Maurice Kay’s decision in [2013] EWCA Civ 553. The issue in contention is whether the proper interpretation of a map of ‘a scale of not less than 1:25,000’ permitted a map which had originally been drawn to a smaller scale, and then enlarged by a computer programme to fit the scale of 1:25,000.


The Council rejected an application seeking modification orders made by the Respondent on the basis that they were not accompanied by maps ‘drawn to a scale of not less than 1:25,000’.


The original decision, upheld in the Court of Appeal, was that a map produced to a scale of 1:25,000, even if digitally enhanced, complies with the statutory requirements in the Wildlife and Countryside Act 1981, under which the original application was made.
