Ross Crail and Claire Staddon are guest contributors in the Summer issue of IPROW's Waymark magazine and comment on recent cases and legal decisions.
Ross Crail writes a case note on R (Andrews) v Secretary of State for Environment, Food and Rural Affairs [2014] where the High Court upheld the Secretary of State's decision on an appeal under Schedule 14 of the Wildlife and Countryside Act 1981 not to direct Wiltshire County Council to make a definitive map modification order adding a bridleway on the basis that it had been created as such by the terms of an 1841 inclosure award
Claire Staddon comments on the case of Church Commissioners for England v Hampshire County Council & Anr and Barbara Guthrie [2014] in which the Court of Appeal allowed the landowners' appeal against the decision of Mr Justice Collins concerning an applicant's delay in putting in order a not duly made town or village green application.
